Single Working Woman Eligible to Adopt a Child, Rules Bombay HC

The High Court of Bombay overturned a district court’s order disallowing a woman from adopting a child based solely on her ‘single working woman’ status. The district court denied the adoption request, citing that a single working woman is incapable of giving sufficient personal attention to the child.

Calling it a “medieval conservative mindset,” the high court noted that a divorcee or a single parent could adopt a child according to the Juvenile Justice (Care and Protection of Children) Act, 2015.

An Aurangabad Single Bench of Justice Gauri Godse was considering a revision application by Shabnamjahan Ansari, seeking a revision of the district court’s order. The high court stated that the reason given by the judge to deny adoption was unfounded, perverse, illegal, unacceptable, and unjust.

Ms Ansari had registered with the child adoption centre to adopt her sister’s child and had followed all the requisite procedures. However, the Bhusawal District Judge rejected the application, claiming that the potential adoptive parent is a single working woman and would not be able to give the attention the child deserves.
